Terms and Conditions
The terms of the road.
The deal between you and the club: membership, club rides, the app, the members' area and the shop. Plain English, no small print games.
Written for a private members' club in plain English. These documents are due a solicitor's review before the D16 app and website launch to the public.
About these terms
These terms are the agreement between you and District 16 (the club), also called D16 or the North Ox Collective, an invite-only motorcycle club in North Oxfordshire. Our legal name and address: [Club legal entity / address]. Contact: hello@district16.club.
They cover your membership, club rides and events, the website at district16.club (including the members' area and the shop) and the D16 app for iPhone and Android. “We” and “us” means the club; “you” means you, the rider.
They work together with the Community rules, the app licence (EULA) and the Privacy notice, which explains how we use your data. You accept these terms when you tick the boxes on the “Before you ride” step after signing in. If you don't agree, please don't use D16.
Membership and eligibility
- 18 and over only. You must be at least 18 to join or use D16. If we find out a member is under 18, we'll close the account.
- Invite-only. There's no public sign-up. You can ask to join, but membership is by invitation from the admin team, and we can decline a request without giving a reason.
- Roles. New riders usually start as a prospect with limited access until the admin team approves them (for example after an induction ride). Then come member, ride captain (experienced riders who plan and lead rides) and admin (the team that runs the club). Admins decide roles.
- Your account is yours. One account per person. Keep your sign-in email, password, app lock and any two-step verification to yourself, and tell us straight away if you think someone else has used your account.
- Keep it accurate. Give us true details (name, bike, emergency contacts) and keep them up to date.
If the club charges a membership fee or subscription, we'll tell you the amount and what it covers before you pay, and it will come with its own terms.
Riding with the club
Every rider on a D16 ride, event or meet agrees to:
- Ride within the law and your limits. Follow the Highway Code, speed limits and road signs. Group pace never overrides your judgement: ride your own ride, and drop back or leave the ride whenever you want to.
- Hold the right licence for the bike you're riding, including any restrictions on it (for example an A2 licence), and carry nothing that would stop you riding legally.
- Have your own insurance. You must have at least the motor insurance the law requires for every ride. The club doesn't insure you, your passenger or your bike.
- Ride a roadworthy bike: taxed, with a valid MOT where one is needed, and properly maintained (tyres, brakes, chain, lights).
- Wear proper kit. A helmet is the law; we strongly recommend full protective gear on every ride.
- Never ride under the influence of alcohol or drugs, or when you're too tired or unwell to ride safely.
- Listen to the briefing. Ride captains share the plan, regroup points and hand signals. They're volunteers, not instructors or professional guides, and they aren't responsible for how you ride.
- No stunts, racing or showing off on public roads. Track days follow the circuit's own rules and terms.
If you bring a passenger, you're responsible for them, including making sure they're properly kitted out and insured.
You ride at your own risk
Motorcycling is dangerous, even when everyone does everything right. You take part in club rides, meets and events voluntarily and at your own risk. The club organises rides as a group of volunteers: we don't supervise, instruct or control how anyone rides, and we can't check every rider's licence, insurance or bike.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to exclude (see our liability).
Routes and suggestions
Routes, turn-by-turn directions, café and meet-spot suggestions, hazard reports, elevation, twistiness scores, times and weather in D16 come from OpenStreetMap, routing and weather services, and other members. They're suggestions, not instructions. They can be wrong or out of date: a road may be closed, private, unsurfaced, flooded, under roadworks or simply unsuitable for your bike, your experience or the weather on the day.
- Check a route before you ride it, and always follow road signs, the conditions in front of you and your own judgement.
- Mount your phone securely and set the route up before you set off. It's illegal to hold and use a phone while riding.
- As far as the law allows, the club isn't liable for any loss, damage or injury that comes from following a route, direction or suggestion in D16.
Safety features are aids, not guarantees
Crash detection, SOS, Home Safe check-ins, live location, crew voice comms, the Medical ID and the helmet QR card are there to help the crew look out for each other. They depend on your phone, its battery, sensors, GPS, permissions and mobile signal, and on other services such as push notifications and SMS. So:
- They can miss a crash, raise a false alarm, or deliver an alert late or not at all.
- They aren't a certified safety or medical device, nobody monitors them around the clock, and D16 never calls the emergency services for you.
- In an emergency, always call 999 or 112 yourself, or ask someone nearby to.
- Only add emergency contacts who've agreed to be contacted, and keep your Medical ID accurate: you're responsible for what it says.
Acceptable use
Follow the Community rules everywhere you represent D16: in chat, on voice channels, on rides, at events and in the WhatsApp group. In particular, don't:
- post anything illegal, threatening, hateful, harassing, sexually explicit or that sexualises anyone under 18;
- share other members' locations, routes, photos, phone numbers or other personal details outside the club without their say-so;
- record crew voice channels or other members without their consent;
- post adverts, spam or scams, or impersonate anyone;
- try to get into other accounts, get round the club's permissions, copy (scrape) club data, overload our systems, or reverse engineer the app except where the law allows;
- use D16 in a way that breaks the law, including using your phone while riding.
What you post
You keep ownership of the messages, photos, routes and listings you post. You give the club a free, non-exclusive licence to store, show and share them with members for as long as they're on D16, so we can run the club. You're responsible for what you post and for having the right to post it. Admins can remove anything that breaks these terms or the Community rules.
The marketplace
Members' listings are private deals between members. The club isn't a party to them, doesn't handle payment and can't vouch for any item, buyer or seller. Never list stolen goods.
Suspension and termination
You can leave any time. Delete your account in the app (Me → Account & privacy) or on the website, or see how to delete your account.
We can suspend or end your membership, or remove access to any part of D16, if you break these terms or the Community rules, put other people at risk, act unlawfully or bring the club into disrepute, or if a prospect isn't approved for membership. We'll usually tell you why and give you a chance to respond first, unless the issue is serious or urgent. Admins make these decisions; you can ask us to look again by emailing hello@district16.club within 14 days.
When membership ends, your access stops, points lapse, and your data is handled as the Privacy notice explains. Paid pre-orders are either fulfilled or refunded in full.
Points, levels and achievements
- You earn points for riding, club rides, events, Home Safe check-ins and helping the map. Levels and patches follow from your points and rides.
- Points have no cash value. You can't sell, transfer or swap them for money. They may be redeemable for club merchandise at the club's discretion, while stocks last.
- We can correct mistakes, remove points gained by cheating (for example faking a ride) and change how points, levels and rewards work. We'll tell you before a change that affects points you've already earned.
- Points lapse when your membership ends.
- Never ride faster, further or in worse conditions than is safe to earn points. No points are worth it.
Shop pre-orders and bank transfers
The D16 shop sells club merchandise by pre-order. Items are made in batches after a drop closes, so delivery dates are estimates.
- Prices are in pounds sterling. Any postage is shown before you place the order. Member prices and early access are for members only.
- Ordering. When you place a pre-order you get an order reference and the club's bank details. The contract is made when we confirm your order.
- Paying. There are no card payments: you pay by UK bank transfer using your order reference, within 7 days of ordering (as shown with your order). If we don't receive payment in time, we can release the pre-order. We'll never email you asking you to pay a different account; if that happens, it isn't us. Check with hello@district16.club first.
- Getting it. Collect at a club meet or have it posted to a UK address. It's yours, and your risk, once it's handed to you or delivered.
- If we can't make it (for example a supplier lets us down), we'll tell you and refund what you've paid in full.
We keep order records for six years for the club's accounts.
Cancelling an order and your consumer rights
Shop orders are distance sales, so the Consumer Contracts Regulations 2013 apply. You can cancel any time before your order is delivered or collected, and for 14 days after the day you receive it, without giving a reason.
- Tell us by email at hello@district16.club with your order reference.
- Send or hand the items back within 14 days of telling us, unworn and in their original condition.
- We refund the price and the standard postage you paid within 14 days of getting the items back (or proof you've sent them), to the account you paid from. Return postage is yours to pay unless the item is faulty or wrong.
- Custom or personalised items, such as a hoodie printed with your name, number or bike, are made to your specification, so the 14-day right to cancel may not apply to them. Your rights for faulty items always do.
Faulty or not as described? Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. You can reject a faulty item for a full refund within 30 days of receiving it, and after that you're entitled to a repair or replacement (or a refund if that doesn't work). Nothing in these terms affects your legal rights.
Intellectual property
The D16 and District 16 names, the brush logo and mark, patch and merchandise designs, and the app and website are owned by the club or the people who license them to us. Wear the merch with pride, but don't use the name or logo on your own products, for commercial purposes or in a way that suggests the club endorses something, without our written permission.
Map data is © OpenStreetMap contributors. Other open-source software in D16 is used under its own licence.
Our liability
D16 is run by volunteers for the club's members. We work hard to keep it running well, but we can't promise it will always be available, error-free or secure, or that alerts and messages will always arrive.
As far as the law of England and Wales allows:
- the club isn't liable for loss or damage caused by your own riding, by other riders or road users, by routes or data from third parties, or by a safety feature not working;
- we aren't liable for loss we couldn't reasonably have foreseen, for business losses (D16 is for personal use), or for events outside our reasonable control;
- where we are liable, our total liability to you is limited to the greater of £100 and what you've paid the club in the 12 months before the claim.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for your rights as a consumer (including for goods you buy from the shop), or for anything else that can't be excluded or limited by law.
Changes to these terms
We may update these terms as the club and the app grow. The version and date at the top always show the current one. If a change is significant, we'll tell you in the app or by email and ask you to accept the new version before you carry on. If you don't agree, you can leave at any time.
Governing law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
